Black L.I. Man Who Was Convicted For Shooting White Teen Pardoned By Gov Patterson After Serving Just 9 Months In Prison

A black Long Island man convicted of killing a white teenager was home for the holidays Thursday after Gov. Paterson commuted his sentence.
John White, 56, was released after serving just five months in an upstate prison for killing 17-year-old Daniel Cicciaro Jr.
"Merry Christmas," a smiling White said when he arrived at the scene of the incident - his Miller Place home - around 1:30 p.m.
"I'm definitely glad to be home with my family for Christmas, and I hope everyone has a pleasant and happy holiday."
There was no immediate comment from Cicciaro's parents, who were not told in advance that White was being sprung.
During his bitter and racially charged trial, White claimed he was trying to protect his family from a "lynch mob" when he fatally shot Cicciaro Jr. on Aug. 9. 2006.
Paterson said he realized his decision - reached in the waning days of his administration - would tear open barely healed wounds.
"While the incident and Mr. White's trial engendered much controversy and comment, and varying assessments of justice were perceived, its most common feature was heartbreak," Paterson wrote.
"The action I am taking today is one of understanding, forgiveness and hope, which I believe are the essential components of justice."
Paterson, who has a week left in office before giving way to newly elected Andrew Cuomo, is not the first governor to spring a convicted felon early.
"We salute Gov. Paterson's decision and hope that all families involved will move towards healing," the Rev. Al Sharpton said. "There are no winners in this situation."
But Suffolk County District Attorney Thomas Spota ripped Paterson for callously disregarding the feelings of the victim's family.
"I strongly believe the governor should have had the decency and the compassion to at least contact the victim's family to allow them to be heard before commuting the defendant's sentence," he said in a statement.
White, a city road construction foreman, was convicted two years ago of manslaughter and criminal possession of a weapon.
When White was sentenced to two to four years in prison instead of getting the maximum 15-year sentence, Cicciaro's family and their supporters were outraged.
"Let's see what happens when Aaron White gets shot," Cicciaro's father, Daniel Sr., screamed, referring to White's then 20-year-old son.
A drunken Cicciaro was killed at the foot of White's driveway after he went to the home with four friends late at night, bent on fighting Aaron White over a bogus rape threat, police said.
They yelled racial slurs and threatened to rape Aaron White's mother, according to cops.
White testified he grew up in Brooklyn hearing stories about how the Ku Klux Klan torched his grandfather's business in Alabama. He said wanted to scare the mob away and that his gun accidentally went off when Cicciaro lunged at him.
Prosecutors said that instead of calling the cops, White went out to confront the teens and shot Cicciaro in the face from three inches away.
The jury convicted White after a four-week trial.

Some Jurors Had Spoken Out After The Trial: "I Definitely Have Some Regrets"

Though a guilty verdict was handed by jurors, a second juror is speaking out about not wanting to find a Long Island man guilty of manslaughter. Donna Marshak told the Post, "I haven't felt right since the trial ended. I definitely have some regrets about not sticking to it."
John White was convicted of manslaughter, as well as criminal possession of a weapon, for fatally shooting 17-year-old Daniel Cicciaro Jr. in 2006. Cicciaro and a group of friends had gotten into a fight with White's son Aaron (over a misunderstanding) and went to White's Long Island home.
His defense lawyers had tried to claim that White, a black man, felt threatened by the "lynch mob" who was also yelling racial epithets and felt compelled to protect his family. The prosecution had argued that White did not need to take a pistol and confront the teens and that he could have locked himself in the house and called the police instead.
The jury had been deadlocked last Friday, December 21, but the judge urged them to push through, especially with the Christmas holiday coming up. The jurors' verdict was delivered the next day, but juror Francois Larche spoke out about being one of two hold outs in the jury who believed there was reasonable doubt for White's actions and did not want to find him guilty. However, Larche said he caved to pressure from other jurors, calling them hostile and rude.
Today, Marshak stepped forward with her insights:
Marshak said she succumbed because Larché had already caved, and she thought she had no chance to resist alone the onslaught of fellow jurors - and would never be able to single-handedly change any of their minds.
"I couldn't believe that some of the people right away knew he was guilty, after about an hour," she said. "Most of the people were respectful, but some just seemed like they just didn't want to listen. It was very difficult."
She also mentioned that she couldn't look at White when the verdict was read and afterwards, when driving home, she had to pull over because she was crying.
