A legal battle is brewing between two players in the entertainment industry. Grove Broadcasting Corporation Limited (IRIE FM) issued a release recently claiming that another group is using the irie trademark.
The release states: IrieTV and IrieTV.com are the registered trademark and domain name respectively of Grove Broadcasting Corporation Limited. It has come to our attention that unauthorised persons have been using this mark or marks similar to our marks (Irie and IrieTV) on the Internet, in Jamaica and in New York, New Jersey and Connecticut.
According to Bobby Clarke, CEO of Irie Jam Media Group which is based in New York, his organization received what he considered a frivolous lawsuit about a month ago from IRIE FM but they never made it public but directed IRIE FM to their lawyers.
Clarke told One876Entertainment.com that he didnt hear anything else from them until now, I was driving in Jamaica and I heard about it (lawsuit) on their (IRIE FM) radio station.
I have about seven companies under IRIE, some I have for the last 15 years, they are incorporate companies with bank accounts and so on as far as I know irie is a rasta term. he said.
The release also sates: This constitutes an infringement of our absolute right to use the Irie trade mark and all common law representations thereof.
This is therefore to put the public on notice that no-one has been licensed or otherwise given permission to use our trademarks or any marks bearing any similarity thereto. We will be taking legal action against all persons who use or continue to use the Mark without our permission.
But according to Clarke, there is no double registering or infringement on IRIE TV, they registered the name in 2003 and went on to operate IRIE TV on cable in New York on Cablevision.
We feel that it is a David and Goliath thing, IRIE FM being the giant they want to try and find some way to quiet the small guy tying to move ahead. said Clarke.
When asked where his company will go from here Clarke responded: We will be leading it from now on, we have advised out lawyers to take it as far as legally possible.
Irie Jam Media PR representative, Anthony Turner told One876Entertainment.com that he thinks this act by IRIE FM is an attack on the integrity of our company, a lot has gone into the launch of IRIE TV and they now sending lawsuit.
