Supreme Court Judge Paulette Williams has freed 40-year-old electrician, Hermain Tulloch, of Bowden Hill district, near Hermitage Dam, St Andrew, of charges of illegal possession of firearm and unlawful wounding.
Tulloch was freed in the Gun Court after the judge upheld a no-case submission by attorney-at-law Michael Lorne, who represented Tulloch.
A taxi driver testified in the Gun Court that on February 29 last year he was sitting in his car when the accused and two other men pulled him out of the vehicle and began to beat him.
He said the car was a left-hand drive and the accused and another man were on the left side of the car. He said a third man whom he did not know was on the right side, and that man used a gun to hit him on his forehead.
After the Crown closed its case, Lorne stated that even if the man on the right side of the car had a gun, there was nothing to show that there was a common design by all the men to use a gun to inflict injury to the complainant.
