Mumbai: The biker, involved in a skirmish with the police on Eastern Express Highway at Vikhroli on Tuesday, succumbed to his injuries at hospital on Saturday. The family, which alleged that Kishore Kandagiri lost control over his motorcycle after a police official flung a helmet at him to stop him, vowed to fight to the end to get justice. But they seem to be in for a long haul; Vikhroli police station officials apparently refused to register an FIR on Saturday against a traffic constable (Yunus Pathan), asking the family why it had come four days after the incident. Eyewitness accounts corroborated the familys claims and there were impromptu protests on the road soon after the incident. And, though the grievously hurt Kandagiri was booked by cops for rash driving, causing minor and grievous injuries, drunk driving, not wearing a helmet and jumping a signal, doctors accounts indicated that police officials might be stretching the truth. Hospital authorities said Dinesh was comatose when admitted. He came in with subdural haematoma (clot in the brain). His breath tests showed no trace of alcohol, Sion Hospital acting dean Suleiman Merchant said. The final nail in the coffin for the police-constructed case could be Dinesh Kewal, who was riding pillion with Kandagiri when the incident occurred on Tuesday. He told TOI that the police had offered him money to keep shut. They will obviously support their colleagues. They didnt even help us to a hospital. We managed to get to there thanks to passersby, he said. The Vikhorli police on Saturday took a fresh statement from Kewal after his allegations about his statement being manipulated by police surfaced in the media. But Kandagiris family, friends and neighbours were not as successful when it came to registering an FIR.
