The Miami Herald reported that T-Pain had received a $75,000 advance for his appearance, which Chase Entertainment offered to return.
''We feel horrible about not being able to play the concert,'' Chase Entertainment's David Abram told The Miami Herald. "We are going to do what needs to be done to make this right with the promoters They're a good company. We're a good company.''
In addition to being sued for breach of contract, Hits and Jams is suing or libel, defamation and court costs.
American hip-hop star T-Pain is being sued Hits and Jams (H&J for his non appearance at a show in Guyana.
According to a story carried in the Guyana Chronicle the company filed an action on Monday, in the 17th Judicial Circuit Court, Broward County, Florida, United States (U.S.), against hip hop superstar T-Pain and Company.
The US$5M claim is for breach of a written contract, libel, defamation and intentional infliction of emotional distress.
A release from the plaintiff said T-Pain was scheduled to perform at Georgetown Cricket Club (GCC) February 23 last, but cancelled the appearance after what his camp described as credible kidnapping and death threats to the singers life.
H&J said, despite several requests, the American superstar and his management team refused to provide the source of the alleged threats to the promoters and their attorney, law enforcement, the Federal Bureau of Investigations (FBI) and the U.S. Consulate in Guyana, to facilitate a probe.
H&J said the R&B artiste and his team merely informed them and their attorney that the threats came from a credible source that T-Pains camp trusted and who they have been dealing with in Guyana and that T-Pain has dealt with the source in the past.
After T-Pain cancelled the Guyana show, several false and incorrect reports in the international media attributed the cancellation of T-Pains appearance in Georgetown, to the promoters, Hits and Jams Entertainment.
The press releases also falsely attributed personal knowledge of the alleged telephone and e-mail threats to the promoters. The promoters do not possess any personal knowledge of the alleged threat or the credibility of the alleged threats, H&J said.
The statement said, according to the first clause of the action, for breach of contract, obtained from the local promoters, they are seeking an award of general and special damages in the above quoted amount, which is in excess of the jurisdictional limits of the Circuit Court, attorneys and Court fees, pre-judgement interest and such other relief the Court deems just and proper, against the defendants.
It added that the plaintiffs, respectfully, reserve the right to seek and assert a claim of punitive damages pursuant to the requirements of Florida Statute 768.72.
Three other causes of action, filed against the defendant, are for libel, defamation and intentional infliction of emotional distress, each seeking US$15,000 awards.

ST. POELTEN, Austria A man accused of imprisoning his daughter for nearly a quarter of a century and fathering her seven children repeatedly raped her in front of the youngsters, prosecutors said Monday as his trial opened in Austria.
Josef Fritzl hid his face behind a blue file folder as a judge began the proceedings under heavy security in St. Poelten, 65 kilometers (40 miles) west of Vienna. Fritzl pleaded guilty to incest and false imprisonment, but only partially guilty to charges of coercion and rape. He pleaded not guilty to murder and enslavement.
Police say the 73-year-old has confessed to holding his daughter for 24 years in a cell he built beneath his home. Investigators say DNA tests show he fathered her six surviving children.
One of the children died in infancy, and prosecutors charged Fritzl with murder, contending the baby might have survived if Fritzl had arranged for medical care.
In her opening statement, prosecutor Christiane Burkheiser accused Fritzl of raping his daughter in front of the children.
Burkheiser said Fritzl didn't talk to his daughter during her first few years in captivity. She alleged that Fritzl once punished the young woman by shutting off electricity to the dungeon.
Defense lawyer Rudolf Mayer appealed to the jury to be objective and not swayed by emotions. He insisted Fritzl was "not a monster."
Fritzl faces up to life imprisonment. A verdict is expected by Friday.
Fritzl's voice was weak and soft as he gave the judge his name and other personal details Monday.
Before the trial got under way, Mayer told The Associated Press his client was nervous.
"He told me, 'I'm scared, Mr. Mayer,'" the lawyer said.
Fritzl eventually removed the folder, but sat still in the dock and stared straight ahead.
Mayer said he had no particular strategy for Fritzl's defense.
Authorities say Fritzl imprisoned and repeatedly raped his daughter, Elisabeth, in the cramped and windowless dungeon he built beneath the family's home in the western town of Amstetten. The crime stunned people worldwide when it came to light last April.
Security was tight in St. Poelten. Police imposed a no-fly zone above the courthouse to dissuade reporters from renting helicopters for aerial shots and to prevent prison breaks from the jail next door where Fritzl has been in pretrial detention.
Mayer welcomed the security, saying both he and Fritzl had received threats over the past year.
Three of the children grew up underground in Amstetten, never seeing the light of day. The other three were brought upstairs to be raised by Fritzl and his wife, Rosemarie, who apparently believed they had been abandoned.
The children, together with Elisabeth, initially recovered from their ordeal in a psychiatric clinic and then were moved to a secret location. Seeking refuge from reporters, they have since returned to the clinic, where security guards are on high alert.
It is the normal policy of The Associated Press to withhold the names of victims of sexual assault, but the identities of two of Fritzl victims have become known. In this case, withholding of the names by the AP became impractical when their first names and the full name of their father were announced publicly by police and details about them became the subject of massive publicity both in their home country and around the world.
None of the victims is expected to testify in court. Instead, the eight-member jury will see prerecorded video testimony from both Elisabeth and one of her brothers, Harald.
In Austria, which does not have the death penalty, murder carries a maximum sentence of life imprisonment. If convicted of enslavement, Fritzl could face up to 20 years behind bars. For rape, he could get up to 15. Incest is punishable by up to one year in prison.
The conviction with the highest penalty will determine the length of the sentence.
Police in Michigan say a 15-year-old boy has died after being Tasered by officers who were trying to break up a fight.
Police didnt release his name and say state police are investigating.
A Bay City police news release says officers answered a report of an early morning fight on Sunday. The statement says two males were arguing in an apartment, and one of them attempted to fight the officers.Police say officers Tasered him, and his reaction led them to immediately call for emergency medical help. He was pronounced dead at Bay Regional Medical Center.
An Amnesty Internationalreport claims that more than 300 people have been killed after being Tasered since 2001 in the US.

Popular dancer, Colo Colo and his girlfriend were both attacked during a video shoot.
According to news report, the incident took place Wednesday night in Half Way Tree. It's alleged that during the video shoot they were attacked by a group of conductors. According to the dancer, the men approached them and asked if they could be apart of the video shoot, an altercation aroused between his girlfriend Lisa Brown and the men. The men then left the scene and return with weapons which were used to inflict wound on Colo Colo, his girlfriend got her mouth busted.
The matter was reported to the Half Way Tree police by Colo Colo who managed to escape from the men.

After 20 years the Simpsons have changed their opening sequence. Lastnight the show had its premier in HD and with it brought the first revamp of the main titles since 1989.
While some of the old parts remain (Bart still writes on the chalk board, Lisa still saxes her way out of music class, and Homer still throws radioactive material down his shirt) most of it has changed to catch up on 20-seasons worth of character additions. Apu's octuplets now appear in the opening as do Maggie's nemesis, the unibrow baby, and the crazy Texan millionaire, all added since the original sequence was created.
As a side note to fans, check out Marge's groceries, they have changed to include tomacco juice, and Mr. Sparkle detergent.

A computer programmer who lost half his finger after his motorbike crashed into a deer has had the finger replaced with a USB drive.
Jerry Jalava, from Finland, says the two-gigabyte prosthetic finger is not permanently attached to his hand, allowing him to leave his finger in the computer slot and "pick it up after I'm ready".
The silicon prosthetic looks like a normal finger, but can be peeled back at the tip to reveal the USB drive.
Mr Jalava uses the drive as storage for "photos, movies and other useful files", The Telegraph said.
"When Jerry told doctors what he did for a living they joked he should have a USB 'finger drive' but that was good enough for him, and he set about making one," the paper said.
Mr Jalava said he had been flooded with questions about the finger after a friend blogged about his unique prosthetic.
He set about answering some of those questions on his own blog.
"First of all it is not attached permanently in to my body, it is [a] removable prosthetic which has [a] USB memorystick inside it," he wrote.
"Secondly when I'm using the USB, I just leave my finger inside the slot and pick it up after I'm ready."
He also described the crash, which happened last July.

One-eyed man plans to implant webcam in spare eye socket

"Last Wednesday while I was driving my one week old Ducati Monster 696 from work to home, I crashed into a deer," he wrote.
"I slided approximately eight metres with the deer on front and after that bounced from side to side 11 metres with the bike.
"Last slide was approximately 58 metres with my left hand under the bike.
"After the bike stopped I got up and took my helmet and gloves off ... that's when I realised that half of my finger was missing."
Mr Jalava said he had installed a number of programs on the USB finger that allowed him to do programming.
He was also working on a more advanced USB finger that would feature wireless tracking.
"I'm planning to use the other prosthetic as a shell for the next version, which will have removable fingertip and RFID [radio frequency identification] tag," he wrote.
A dispute between two teenagers in Catherine Hall, Montego Bay, St James, on Saturday night left one dead. The other has been taken into police custody.
Dead is Francis McDaniel, 17, while a 19-year-old has been arrested.
Police say about 11:50 p.m., the teens were involved in a dispute. The fracas escalated into a fight during which a knife was brought into play and both received injuries.
They were taken to the Cornwall Regional Hospital where McDaniel was pronounced dead. The other was treated and released into police custody.
The two-week-old boy from Russia, named only as Artyom G, has had an operation to join the two penises.
Doctors say his mother had a normal pregnancy and no problems were detected.
"The surgery was complicated. We had to form one penis out of two, make the abdominal wall and create a bladder," said a doctor involved in the five hour operation.
According the The Sun, St Vladimir's Children's Clinical Hospital said that the baby is now in good health and the surgery a complete success.
"He will grow into a normal man and be able to have kids," the doctor added.
Garfield Anthony Sibbles, son of popular reggae singer Leroy Sibbles, was yesterday given a six-and-a-half-year sentence for killing a child that had been left in his care.
According to a story published yesterday on the Toronto STAR's website, thestar.com, 40-year-old Sibbles will only spend six months or less in jail because of "credit earned while awaiting sentencing". Sibbles has been in custody since his arrest nearly three years ago. He pleaded guilty last November to manslaughter, after the March 22, 2006, death of a baby who was just a few days shy of his first birthday.
Sibbles denied beating the child, but admitted that on that day, he took out his frustration and anger on him. He admitted that he slapped him on the side of the head when he refused to swallow his food and later shook him when he fell and became unconscious.
According to police Lt. Thomas Welch, a fight broke out in the street before the groups got in vehicles and a chase ensued.
Welch said officers pulled over both vehicles and arrested four people, including the original two robbers, ages 40 and 31, and two robbers from the second group, of ages 22 and 27. All four are from Illinois.
But he said police didn't recover any cash or jewelry and are searching for more suspects in Wednesday's incident.

Days after the police force was rocked with the embarra**ing revelation of having a fake cop on staff, news has emerged that three of its members robbed a customer at a Western Union office in Montego Bay on Saturday afternoon.
Reports are that two men attached to the Island Special Constabulary Force (ISCF) and a district constable held up a customer at gunpoint in the money-transfer store on Market Street. They escaped with hundreds of thousands of dollars, gun-butting the customer before leaving with the loot.
The robbery has been reportedly linked to the lottery scam, which has been blamed for Montego Bay's crime surge.
Manhunt launched
Following investigations, the police reportedly set up a sting operation and the men were identified. However, only one was held. The other two escaped.
Their colleagues have since launched a manhunt for them. It is believed that they have been the masterminds behind several major robberies in the parish of St James.
Since the start of the year, five policemen in the parish have been placed behind bars for corruption-related incidents while several others are being investigated.
When The Gleaner sought to confirm the story on Sunday night, commander in charge of the ISCF in St James, Commander Leonard Mason, said he had "no knowledge of any Western Union being robbed by any of my men".
Superintendent Maurice Robinson, head of the St James Police Division, said he could comment on the matter Monday.

More organisations have come on-board to assist the children of Martha's House who lost their belongings in a fire last Monday.
Martha's House, located on North Street, Kingston, was home to 30 children until it was destroyed by the blaze.
Wynlee Distributors Limited yesterday answered the need for food and clothing.
Winsome Halliman, CEO of WYNLEE, said that, being part of the community, the members of the organisation did not hesitate to assist.
"Though no lives were lost, the children lost everything, so we see it as a good gesture as a corporate responsibility to come on, board and make this special donation," Halliman said.
She further encouraged other persons to assist as the situation was painful.
Also yesterday, Telecommuni-cations company LIME and its parent company Cable & Wireless International (CWI), donated $2 million to rebuilding Martha's House.
Residents say the suspected man has a liking for older women. He is alleged to ejaculate on panties which he then leaves on the ground along with a note professing his love for the victims.

Mi went to di Irie FM awards last week and I was so surprised. After mi a hope seh dem woulda messed up so mi can get fi slaughter dem, but that never happened because di ting gwaan good star. The assembly at the Mile Gully High School was in awe watching the number one scout troupe in Manchester - The Mile Gully High School Scouts. The troupe was on parade at the ceremonial raising of the Jamaican flag at the Jamaica day celebration. Mile Gully High School is one of the schools selected as a centre of excellence by the Mutual Building Societies Foundation, a collaboration between Jamaica National and Victoria Mutual Building Societies.

A vehicular accident along the Ewarton main road in St Catherine yesterday has left one man dead and four others injured.
The Ewarton police identified the dead man as Patrick Clunis of Angel Estate in St Catherine. Those injured are Donald Deam of Ocho Rios, St Ann, and Clement Powell of Worchester Road, Sydenham, Spanish Town, St Catherine. The other two passengers have not yet been identified.
Reports are that about 5:30 yesterday morning, Clunis was a passenger in a Toyota Corolla motor car travelling in a northerly direction. On reaching an area known as High House, the car collided with a Toyota Hiace which was heading in the opposite direction.
The fire which occurred about 9:45 Sunday morning destroyed the seven-apartment building on Richings Avenue in Liguanea, St. Andrew. Sizzla reportedly left home to attend a meeting when he received a call that the house was on fire. Sizzla's grandfather, who was reportedly at the premises at the time, sustained minor injuries. It is not yet clear what started the fire which caused extensive damage. |
