A 21-year-old man was charged with first-degree murder Tuesday after police said he snatched up his ex-girlfriends 3-month-old son during a fight and then threw the baby from his car on an interstate highway.
The childs lifeless body was found near Interstate 275 north of downtown Tampa early Tuesday. The man, Richard A. McTear Jr., was captured several hours later. Deputies said he is not the childs father.
The Hillsborough County Sheriffs Office said McTear was arguing with his 17-year-old ex-girlfriend, Jasmine Bedwell, at her apartment when he began beating her and the child. She reported that McTear threw her son, Emanuel Wesley Murray, down on the concrete, then picked him up and fled in his Chevrolet Impala.
Jason Bird, a news photographer for WTVT-TV in Tampa, spotted the babys body on his way to work at about 4:30 a.m.
On the side of the road, I saw something out of the corner of my eye and at first I thought it was a baby doll, and then as I was thinking about it more I thought that was awfully big for a doll, Bird said in an interview on the station.
He turned around and went back to take another look.
It was laying there with its eyes open, he said. I couldnt look at it. It freaked me out, but fortunately law enforcement came right away.
Its hard to find words to describe why someone would do this to a poor, defenseless child, sheriffs Maj. Harold Winsett told reporters at the scene.
Deputies located McTears car at his home. Witnesses told deputies where he could be found, and he was arrested about four hours later after a foot chase.
McTear also was charged with burglary with a battery, felony battery, aggravated child abuse and kidnapping, said sheriffs spokeswoman Debbie Carter.

According to the Florida Department of Corrections, McTear was sentenced to two years probation in June 2008 on a felony battery conviction. An arrest warrant was issued when he failed to report.
Last month, Bedwell sought an injunction against McTear for domestic violence, but the case was dropped because she didnt appear in court.
In court papers, Bedwell said McTear was violent, often armed and had a drug problem. She said he had forced his way into her apartment and beat her.
McTear had not yet appeared in court and did not yet have an attorney.

Hoang Nguyen, 35, is being held on suspicion of attempted murder for the Tuesday night incident in Colorado Springs, Colo., about 70 miles (113 km.) south of Denver, said police Lt. David Whitlock.
Chapman, star of the A&E network's "Dog the Bounty Hunter," escaped unharmed, Whitlock said.
Whitlock said Chapman, 56, and his partner Bobby Brown were at a Colorado Springs apartment complex trying to apprehend Nguyen for skipping bail on a number of failure-to-appear warrants when they apparently were shot at.
Chapman apprehended Nguyen several blocks away from the incident early Wednesday morning, Whitlock said.
A statement on Chapman's Web site said, "Nguyen allegedly fired at least one shot at Chapman, and escaped on a red motorcycle."
But Whitlock said investigators didn't find evidence at the scene that conclusively proved a shooting occurred. "We didn't find any weapons, shell casings or bullets in cars or buildings which are commonly found at these types of scenes," he said.
Still, based on Chapman's account and several witnesses who said they heard gunshots, Whitlock said police will present the case to prosecutors to determine whether attempted homicide charges should be filed against Nguyen.

Chapman made headlines in 2003 for apprehending wanted rapist Andrew Luster, an heir to the Max Factor cosmetic fortune, who fled to Mexico. Mexican authorities charged Chapman for violating that country's laws for the arrest, but later dismissed the charges.
In 2007, A&E suspended production of "Dog the Bounty Hunter" after Chapman was tape recorded making racial slurs about his son's African-American girlfriend. Chapman publicly apologized for that incident.
Sara Watson, who is studying drawing at the University of Central Lancashire (Uclan), took three weeks to transform the car's appearance.She created the illusion in the car park outside her studio at Uclan's Hanover Building in Preston.
The car is now being used for advertising by the local recycling firm that donated the vehicle.

At the start of the second half Ronaldo did manage to create a chance for himself, only to drag a shot badly wide.
With the momentum continuing to favour Wigan, Ferguson introduced Tevez just before the hour - the South American having been left out, proving whatever else his one-man demonstration at Old Trafford on Sunday achieved, it did not influence team selection.
Where Tevez can leave a genuine impression is on the field. And, just as on Sunday, his timing was perfect, diverting Carrick's low shot into the net with a deliberate flick of his heel.
The glee on the Argentinian's face was at odds with that of a man desperate to leave Old Trafford, the urgency of Ronaldo's demands for him to get back for the restart at odds with the attitude of a man whose mind has already drifted elsewhere.
Mind you, Ferguson was not too impressed 10 minutes from time when Tevez rolled a neat pass to Ronaldo, who promptly blazed over as glory beckoned.
Yet three minutes later Carrick popped up with his winner to leave United on the brink of retaining their crown.

Carlos Tevez: United future in doubt
Tevez was on the scoresheet again tonight, grabbing the all-important equaliser as United secured a 2-1 win at Wigan Athletic to move within a point of another league championship.
The glee on Tevez's face suggested he was a happy man, with United boss Ferguson then claiming an offer had been lodged in discussion with the South American that he hoped would be accepted.
However, Tevez's advisor Kia Joorabchian immediately responded with a statement of his own, hinting the Argentina star no longer wishes to remain at Old Trafford.
In a statement released by Joorabchian said: ''It is true (chief executive) David Gill came to see Mr Joorabchian and they had a cordial meeting. It is categorically untrue that Manchester United made an offer to try to persuade Carlos Tevez to stay at the club.
''In 2007 Manchester United agreed a two-year loan deal for Carlos Tevez and at the same time agreed the terms that would make the transfer permanent. They have not taken up that option.''
Joorabchian's stance will not endear him to the United support, who chanted 'Fergie, sign him up' when Tevez found the net with an impudent back-flick minutes after his introduction as a substitute.
''The fans love him because he is a trier,'' said Ferguson. ''He has great skill, of course, but he never gives in and that is a great quality to have. He has a hunger to fight all the time. It is wonderful to see.
''David Gill has had a good meeting and I have spoken to him. We have given him an offer and we hope he accepts. The problem is we are not negotiating with a football club.''
Tevez originally arrived on a two-year loan deal, which gave United an option to buy his registration this summer.
However, dealing with Joorabchian has proved to be a difficult process and Wednesday night's development hardly indicates it is going to get easy, especially as Tevez's advisor knows his player has many suitors.
For United, those problems will be shelved on Saturday if they get a point from their home match with Arsenal.
It would mean that for only the second time during Ferguson's spell in charge, the Red Devils would clinch the title in front of their own fans.
''We still have a job to do,'' said Ferguson. ''I have not listened to all the criticism Arsenal are getting. This is a good Arsenal team and we will need to be at our best to beat them.''
Michael Carrick's 87th-minute strike ensured United do not actually have to win, while condemning Wigan to a ninth defeat in nine meetings with United.
It had looked so good at half-time as the Latics led through the excellent Hugo Rodallega. But the Col****ian's efforts proved to be in vain, leaving Wigan manager Steve Bruce still without a win against his old club.
''I think I will just give up now,'' he smiled ruefully. ''At half-time we had a chance and were doing really well. But this is what happens against United.''

Yaya Toure levelled for Barca in the first half before Lionel Messi, Bojan Krkic and Xavi struck after the break to give the club their 25th Copa del Rey.
The Catalans could wrap up the Primera Liga title this weekend and they face Manchester United in the Champions League final on May 27.
"Now we are reaping the rewards of all the hard work we have put in during the season," Barca midfielder Sergio Busquets told Spanish state television as the team celebrated on the pitch.
"I hope this weekend we can secure our second title."
Barca had an unfamiliar look in defence with reserve keeper Jose Manuel Pinto in goal and Yaya Toure at centre back again, and they were quickly exposed at a set piece.
Pinto had tipped a Javi Martinez shot round the post and Fran Yeste made it count. His whipped-in corner after nine minutes found Gaizka Toquero rising above two defenders to head in at the back post.
Athletic looked fresher, snapping at Barca all over the pitch, until Toure stepped up to level in spectacular fashion as he advanced out of defence.
The Ivory Coast midfielder went past three Bilbao players in the 31st minute, and from outside the area drilled a low shot inside the near post.
Gradually Barca asserted themselves and as they swarmed round the Bilbao area in the 55th minute it was Messi who struck, firing through a crowd of legs after Gorka Iraizoz could only parry Samuel Eto'o's shot.
Three minutes later, Bojan raced through on a break to score off the far post and with Bilbao reeling Xavi curled a superb freekick over the wall and in off the near post in the 64th.

A boy playing cops and robbers with a toy handgun has been shot and wounded by a Los Angeles County sheriffs deputy, officials say.
The boy was shot on Sunday night in Palmdale, north of downtown Los Angeles.
Police Deputy Jeff Gordon said the boy was hospitalised in a stable condition and was expected to survive.
His age and identity were not immediately released.
Gordon said deputies were responding to reports that someone was riding a bicycle and brandishing a handgun.
They spotted the rider and ordered him to drop the weapon but instead he pointed it at the deputies, Gordon said.
One deputy fired a shot and hit the boy in the upper body.

Controversial deejay Rodney Pryce, aka Bounty Killer, will appear in the Traffic Court on July 29 to answer to charges of obstructing traffic and disobeying a red light.
Pryce, who was charged in relation to an incident that occurred on December 29, 2008, had his case called up in court yesterday but his lawyer was absent, therefore a new date was issued.The Argentina forward told British media Sunday that he has not been treated as "one of the family" at Old Trafford and that the European and English champions have made no attempt to negotiate a transfer deal with the investment company that owns his registration.
"I am very sad about this but I guess what I'm saying is goodbye," he said. "I don't think I will be a Manchester United player next season. I have done everything I possibly can but they have never made me an offer or given me a contract so I have to leave.

Manager Alex Ferguson has expressed irritation in recent months when asked about the future of the player who joined from West Ham in 2007.

Hip Hop power player 50 Cent has been cleared of any wrongdoing in the fire that consumed his Long Island Mansion occupied by his son, Marquise Jacksonn, and Marquises mother, Shaniqua Tompkins.
Fif was being investigated after the $1.4 million estate went up in a blaze while he was trying to get Tompkins, the mother of his child, evicted.
Tompkins and their son were both taken to the hospital after the blaze which resulted in both parties filing restraining orders against each other.
According to reports, the police department and insurance investigators ruled that there is absolutely no proof or evidence suggesting that Fif or any affiliated parties were involved.
Fif was cleared of all accusations. The investigation will continue until the guilty party is found.

Manchester City boss Mark Hughes has angrily dismissed talk of a transfer bid for Real Madrid striker Raul, claiming all the speculation is just another example of agents trying to take advantage of the club's vast resources.

Reports in Spain at the weekend claimed City, owned by the immensely wealthy Sheikh Mansour bin Zayed Al Nahyan, had offered 31-year-old Raul the chance to finish his career in England with a lucrative contract.
On Monday, the Madrid captain said his representatives had indeed been contacted by City, but stated his intention to finish his career at the Santiago Bernabeu.
"It's true that there has been contact with my representative, Gines Carvajal, from Manchester City, but I've not considered it, because I'm not going to leave here," Raul toldMarca.
But Hughes claims there was no official approach from his club and has spoken out after growing frustrated with the sheer number of players being linked with a move to Eastlands.
"What everyone has to understand is that there are a lot of people out there who profess to have mandates to work for Manchester City and who are approaching players, apparently on our behalf telling players they can get deals for them and asking if they are interested," the City boss said.
"Some players then react and some don't but it is a situation that has happened time and time again this year and that is why there is so much speculation about players that we supposedly approach.
"There are a lot of people who are out there who would like to manufacture deals and situations where they would in turn become part of a big money move for a player to come to City.
"Raul is an exceptionally talented and great player and has been for many years. He is someone I clearly admire and respect enormously and has done great things for his club and his country but I have not tried to sign him. He will not be coming to City."

David Silva: Liverpool target
Reds manager Rafa Benitez withdrew from the original transfer talks a few months ago after the cash-strapped Spaniards went public in an attempt to spark a bidding war with Juventus, Inter Milan, and Barcelona.
But it is now claimed that Liverpool have tabled a final £15million offer for the 23-year-old and Silva's representative, Jose Segui, admits there is interest in the midfielder.
"At this time it is normal there are many stories in the papers about transfers, but the decision depends on Valencia," Segui told Sky Sports. "It is certain that some clubs have asked about the boy, but he has a deal with Valencia and he is happy in the city."
Benitez, who left Valencia to become Liverpool manager in June 2004, has been courting Silva for a long time but was unhappy with the way the La Liga club handled negotiations when they eventually began back in March.
Benitez fumed: "Our chief scout was in Valencia and talked with different people from the club but someone was talking too much. If we are going to look for someone we will not announce it to everyone - we will try to do it properly and secretly."
Valencia sporting director Fernando Gomez, who admitted that Silva and striker David Villamight have to be sold to serve club debts of between £350m and £450m, insisted no decisions would be made until the end of the season with Los Che still battling for Champions League qualification.
"Now it is impossible to negotiate anything because the future of the team in qualifying for Europe is not decided and that is key for the budget next season," Gomez said.
Chelsea players angrily accused Norwegian referee Tom Henning Ovrebo of missing several penalty and hand-ball calls in Wednesday's 1-1 draw against Barcelona, which advanced to the final with a late goal.
London's Evening Standard newspaper reported death threats were made over the Internet against Ovrebo.
Chelsea promised Thursday to take "the strongest action" against any fans found making threats, but said it had received no evidence of any.
Security officials had to restrain a cluster of angry Chelsea players from confronting the referee as he walked off the pitch.
Striker Didier Drogba and winger Jose Bosingwa apologized Thursday for their angry reactions after the match.
The Blues had four penalty claims turned down during the 1-1 draw, which saw Barcelona through to the final, and European football's governing body confirmed on Friday that they had received match reports from referee Tom Henning Ovrebo and their match delegate detailing the angry scenes that followed the final whistle.
Disciplinary chiefs will now study the reports "as well as gathering additional evidence" before deciding on what action to take but a high-ranking source close to UEFA warned: "Watch for the fallout - it could be tough."
The source, quoted in The Times, added that a hefty fine was the likely punishment, but forcing Chelsea to play their opening home group-stage match next season behind closed doors, or at a neutral venue, could not be discounted.
As many as four Chelsea players could face individual charges after surrounding Ovrebo in an aggressive manner and for their post match comments. The London club could also face a charge of failing to control their players.
Didier Drogba is facing the stiffest sanction following his lengthy confrontation with Ovrebo on the pitch and in the tunnel, although his public apology may lessen any punishment.
Michael Ballack could also be charged for running 40-yards to confront the Norwegian referee after the fourth penalty appeal was turned down during the game - an act for which he was yellow-carded.
Chelsea full-back José Bosingwa faces sanctions for describing the official as a "thief" who was "bought", although he has since retracted those comments, while skipper John Terry also criticised Ovrebo as emotions ran high at the end of the semi-final.
A UEFA spokesman said: "We will see the report from the referee and match delegate before deciding whether to take any action or not."
"Drogba could be banned for a number of matches, we don't know how many. It would be decided by a controlling body, if they decide to open the decision.
Chelsea manager Guus Hiddink, along with opposite number Pep Guardiola, questioned some of the referee's decisions but UEFA will not be drawn into any discussion about his performance or suggestions that they did not want another all-English final.
The UEFA spokesman added: "We never comment on the performance of the referee."
UEFA's general secretary David Taylor dismissed any suggestion of a conspiracy to avoid a repeat of last year's all-Premier League final.
Hiddink was repeatedly asked about "a conspiracy" at the post-match news conference - something that infuriated Taylor, who pointed the finger at the media instead.
Taylor said: "If anything it's a media conspiracy against UEFA. It does make me angry. It really annoys me because it's a load of rubbish."
UEFA also confirmed they had not been contacted by Barcelona about a possible appeal against Ovrebo's decision to send off Eric Abidal following a second-half clash with Nicolas Anelka.

Agent Adrian Ruocco confirmed Argentina international Tevez is attracting interest from Italy and Spain, plus clubs from within the Premier League.
Tevez has scored crucial goals for United this season but said at the weekend that he expects to leave the club at the end of his two-year loan contract.
The 25-year-old claimed he had not been treated as ''one of the family'' at Old Trafford.
Ruocco told Argentinian newspaper Ole: ''He might move to Spain, Italy or stay in England. There are interested clubs from all those countries.
''He already said he would like to stay in the Premier League because he likes football in the country, so he fortunately will decide where he will play. He is lucky to have the chance to choose.''
Ruocco has been surprised that United have not moved to sign Tevez permanently.
Ruocco said: ''There was no will from the directors and the coach (Sir Alex Ferguson) to sign a new contract.
''On May 31, he will have no club and no contract. I don't know why, but Manchester (United) have not asked for any renewal (of the loan) nor signing him for next season.''
He added: ''The directors and the coach do not seem to want him, while on the other hand fans love him.''

I checked this site the other day, and I saw that a new Flo Rida song had broken a digital sales record, and I wasnt sure what to think. I had to check to see if it was the very same sales record that had just been broken by the three-headed beast of marginal relevance that is Eminem, Dr. Dre, and 50 Cent, which, for what its worth, had originally been set by Flo Rida, a year or so ago.
As it turns out, it was. Just the other day, that Em, Dre, and Fiddy song sold 418,000 digital downloads in one week, which made it the highest debut on Billboards still relatively new digital sales chart evar, even more so than T.I.s obnoxious Live Your Life, which broke the record back in October, with 335,000 downloads its first week, and Flo Ridas Low, which set the record back at the beginning of 2008.
I wasnt about to spend the time it would take to see how many copies Low sold its first week out, though I see it once sold 467,000 copies in a week, and thats still considered a record. That must have been its very best week. I wonder if Eminem will eventually break that record. Youd think it wouldnt be that difficult, since he already broke the first week sales record, but then Crack a Bottle might not have legs, as they say.
Flo Rida could just as easily end up breaking his own record, since I imagine most people are like me, in that they wouldnt know from Right Round, the new Flo Rida song. Or who knows, maybe Im just behind the curve on this new Flo Rida, as I was with Low. It had already been the most popular song in the country for quite some time before I even heard it - on the white hip-hop station, natch. This despite the fact that I do sorta kinda work in hip-hop journalism. Ha!
I figured Id do the right thing and have a look at Right Round, but I couldnt even find it in this sites Bangers section. To date, Ive yet to actually hear it. I thought I might have heard it in the car the other day on the way home from work, on one of Sirius godawful hip-hop stations, but come to find out it was some new song by 05-era Texas rap also ran Slim Thug, who I guess is mounting a comeback effort, if you will. Is that what hot in the streets, niggas rapping over The Safety Dance and what have you?
All of which begs the question: How in the f**k did this new Flo Rida song manage to become so popular that its selling upwards of half a million copies a week, if Ive never heard of it, and you cant even listen to it on this, the website of the most popular rap magazine evar (for what its worth)?
Selling half a million digital downloads a week might not be preferable to selling that many albums a week, which Flo Rida almost certainly wont be able to do, in that, if an artist only makes a tiny percent of the price of an album, which costs $12 or whatever, you can only imagine what they make from the price of $.99 digital download.
Still, its better than nothing. Especially these days. Lest we forget, that new Cappadonna album only sold as many copies as he bought to try to sell to people who ride in his cab. And I wouldnt be surprised if that doesnt turn out to be this years worst selling rap album. Is there ever gonna be a new Little Brother album, or has that R&B money got too good to Phonte?
There must be an entire community of people who could give a rats ass about anything us bums here on the Internets consider hip-hop. We hardly even know who these people are, and yet, theres obviously enough of them to float an entire industry by themselves. Flo Rida has somehow managed to tap into this community. It goes without saying that Oprah Winfrey wields some major starmaking power, so when someone signs a multi-platform, multi-year development deal with Harpo Productions, get ready to see a lot of them. The latest beneficiary of Oprah's media might is Jenny McCarthy, who's on track to create a syndicated talk show for Harpo after inking just such a deal. In the meantime, she launched a blog called "Give It Up Before Summer" on Oprah.com this past Friday. The "it" currently being given up is refined sugar, which McCarthy seems to have sworn off because, she explains, "I would always complain to my friends that I wish there were AA meetings for chocoholics." Also, just FYI, Jenny McCarthy was PMSing this weekend. And she refers to her "awesome husband" even though she and Jim Carrey are not technically married. So many things to learn from this blog!
So far McCarthy's been a Playboy model, an actress with a knack for gross-out comedies, an MTV dating show host, an outspoken parent, and, recently, a frequent guest on Oprah. Not a bad career arc. Now, clearly, she's poised to become a bigger phenomenon than ever. So now's the time to speak up: What sort of projects would you like to see emerge from her Harpo deal? The sky is the limit here.
But, while most of the hip-hop blogosphere has already digested the album and decided whether or not they like it, some of us at GIANT think Eminem may have a game-changing trick up his sleeve.
If youve listened to Relapse then you know that the majority of the album is a maniacal and murderous marathon helmed byEms alter-ego Slim Shady. If this is actually the real album, then it leaves much to be desired. But would Em really return from a five-year self-imposed exile to drop a revved-up caricature of himself spitting about serial killing and pill-popping? We just dont see it.
Em says it himself on the second to last track of the album. When Marshall drops off the final copy of Relapse to the always angry Steve Berman, Steve says Whats this shit? Two CDs? Em replies Thats what Ive been trying to tell you man, its two albums. Then he exits the room.
There have already been rumors that Mr. Mathers will drop two albums this year, but Relapse is too redundant and incomplete to be either of them in their entirety.
No Em, We dont believe you, you need more people!
Marshall Mathers may be a bit crazy but he is also multi-faceted. Weve heard very personal, political and insightful records from him before and he has been through way too much in his personal life to not come clean here.
Keep in mind that Em has dealt with prescription drug addiction, a second divorce from Kim, the adoption of a second daughter and the murder of his best friend ALL since his last album, Encore, came out. He has also raised his beloved and often-mentioned daughter Hailie Jade.
We find it highly unlikely that an Em comeback album would not meaningfully address Hailie or Proof. Would not berate Bush, kill Kim or critique society. Ems pen game is still mean and his lyrics and storytelling are on point, but his genius has more meaningful content to address. Unfortunately outside of Deja Vu and Beautiful Relapse chooses to focus on a sick-minded marauder raping, pillaging and torturing innocent bystanders. Slim Shady may be a chainsaw-wielding psycho, but Eminem and Marshall Mathers are not.
Let us not overlook the fact that the reclusive perfectionist known as Dr. Dre would probably not make his return to hip-hop with these beats. Relapses production isnt bad by any means, but none of the tracks are jaw-dropping sonic revelations.
Remember that Dre has been hibernating too. He has been cuddled up with Detox for the last eight years refusing to release it till its juuussst right. We cant imagine a scenario in which Dre would return to society with the batch of instrumentals featured on Relapse. He and Eminem are both capable of too much more.
The highly unlikely coup that could knock rap on its ass if it came to be, is if Detox is the second disc of Relapse. The theme would work to symmetrical perfection and Em could redeem himself over Dres dopest shit.
Maybe were just conspiracy theorists, but we cant believe that one of raps GOATs would return just to rant and rave. We know that Eminem is doper than this and have a suspicion that his marketing genius is about to be revealed too. For all the aforementioned reasons we are calling Relapse a Tour-de-Farce. If were wrong, chalk it up to our own paranoia.
